TERMS AND CONDITIONS
Agreement between Submitter and Dracolich magazine 

This Agreement is made once the submission is accepted by Dracolich Magazine, between the Submitter (“Author”) and Dracolich magazine (“Dracolich”). Dracolich desires to publish the chosen submission, such as a short story, essay, creative nonfiction, poetry, or other (“the Work”). 

Grant of License: The Author grants Dracolich the exclusive license to publish the English language Work, in print, audio, and electronic form, throughout the world. The Author retains the right to publish the Work in a book-length collection of the Author’s works, or as part of a volume from which the Work is an extract. 

Certification: The Author certifies that the rights and that the integrity of the work is original to the Author. The Author guarantees to Dracolich that they will not introduce into the work any matter of an objectionable or libellous character which was not present in the Work. 

Copyright: Copyright to the original work will remain with Dracolich unless otherwise requested by the submitter. Upon notification, it will then be reverted back to the Author. 

Dracolich Anthology: This permission includes the right to reproduce the Work in any Dracolich anthology. 

Sublicensing: This permission includes the right to reproduce, promote, and sublicense the work to other websites, magazines, or publishers. The proceeds of any sublicense will be divided equally between the Author (or Original Publisher, as designated), and Dracolich.

Reservation of Rights: Dracolich reserves the right not to publish the work, in which case Dracolich will revert all rights in the work to the Author. In the case of non-publication of the translation, the Translator will not be compensated. 

Reversion of Rights: If this work is not published by Dracolich in any form within twelve months of the signing of this agreement, all rights herein discussed will revert to the Author. 

Promotion: The Author’s name will be prominently featured in Dracolich, and they will be asked to provide a short biographical note. The Author will have the opportunity to provide a link between this material and his or her own professional website. 

By submitting, it is agreed that the Author agrees to these terms and conditions. 

Optional Waiver of Proceeds: The Author grants permission for the use of the Work described above, and any sublicensing proceeds due to him or her, as a donation to Dracolich. 

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States.
